Hyatt is trying to block Hilton's trademark application for Select by Hilton, arguing it's too similar to Hyatt Select. Is there merit, or are the brands different enough?

Been involved in one TM dispute in UK but learnt quite a bit from it. Admittedly I have no idea how things work in the USA but I would expect this would be a pretty clear cut TM infringement by Hilton. Definitely the potential for customer confusion between the brands given that it is the same word in the same industry so I would expect a judge to rule in favour of Hyatt.

Reminds me of: “Jacobs by Marc Jacobs for Marc by Marc Jacobs. In collaboration with Marc Jacobs for Marc by Marc Jacobs.”

One can only marvel at the state of the industry's creativity and innovation when big company A could only come up with [Company's Name] "select" and its competitor, big company B, could only follow with "select" [Company's Name].
